> Dear Customer,
>
> We are writing on behalf of Cox Communications to advise you that we have received a notification that you are using your Cox High Speed Internet service to post or transmit material that infringes the copyrights of a complainant's members. We have included a copy of the complaint letter. Pursuant to the provisions of the Digital Millennium Copyright Act ("DMCA"), which is codified at 17 U.S.C. § 512, upon receiving such notification, Cox is required to "act expeditiously to remove, or disable access to" the infringing material in order to avoid liability for any alleged copyright infringement. Accordingly, Cox will suspend your account and disable your connection to the Internet within 24 hours of your receipt of this email if the offending material is not removed.
>
> Please be aware that the DMCA also provides procedures by which a subscriber accused of copyright violation can respond to the allegations of infringement and, under certain circumstances, cause his or her account to be reinstated. To do so, however, the response must meet certain criteria. Pursuant to section (g) of the DMCA (17 U.S.C. § 512(g)), you have the right to submit to Cox a counter-notification which, to be effective, must include the following elements:
>
> (a ) a physical or electronic signature of the subscriber;
> (b ) identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled;
> (c ) a statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
> (d ) the subscriberÂ’s name, address, and telephone number and a statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located.
>
> In the event that you submit to Cox a counter-notification that includes these elements, Cox will forward your counter notification to the complainant and advise them that Cox will cease disabling access to the allegedly infringing material in ten (10) business days. Unless the complainant notifies us that it has filed an action seeking a court order to restrain you from engaging in the allegedly infringing activity prior to the expiration of those ten (10) business days, Cox will reactivate your account.

> Dear Sir or Madam:
>
> USA Cable Entertainment LLC are the exclusive owners of copyrights in many motion pictures, including the motion pictures and television properties listed below.
>
> It has come to our attention that Cox Communications is the service provider for the IP address listed below, from which unauthorized copying and distribution (downloading, uploading, file serving, file "swapping" or other similar activities) of USA Cable Entertainment LLC motion picture(s) and television properties listed below is taking place. We believe that the Internet access of the user engaging in this infringement is provided by Cox Communications or a downstream service provider who purchases this connectivity from Cox Communications.
>
> This unauthorized copying and distribution constitutes copyright infringement under Section 106 of the U.S. Copyright Act . Depending upon the type of service Cox Communications is providing to this IP address, it may have legal and/or equitable liability if it does not expeditiously remove or disable access to the Infringement listed below, or if it fails to implement a policy that provides for termination of subscribers who are repeat infringers (see, 17 U.S.C. 512).
>
> Despite the above, USA Cable Entertainment LLC believes that the entire Internet community benefits when these matters are resolved cooperatively. We urge you to take immediate action to stop this infringing activity and inform us of the results of your actions. We appreciate your efforts toward this common goal.
>
> The undersigned has a good faith belief that the use of the property(ies) in the manners described herein is not authorized by USA Cable Entertainment LLC, its agents or the law. The information contained in this notification is accurate. Under penalty of perjury, the undersigned is authorized to act on behalf of USA Cable Entertainment LLC with respect to this matter.
>
> Please be advised that this letter is not and is not intended to be a complete statement of the facts or law as they may pertain to this matter or of USA Cable Entertainment LLC positions, rights or remedies, legal or equitable, all of which are specifically reserved.

    Well...what can I say, shit happens.
  • Hasn't hit me up with that for anything I DL. They must have some specific tracker for BSG.
  • BigglesBiggles The Man Without a Face
    Most likely, they just fired up the torrent one day, recorded all the IPs involved in it, then went through the list.

    Then take the files out once thay have Downloaded

    Edit: I wonder when they are going to send me a love letter. Any way, better clear out my downloaded folder. *sigh*
  • BigglesBiggles The Man Without a Face
    That doesn't help. You transmit while your downloading, there's no way to avoid that because that's how the system works.

    I find it funny that you got one of these on BSG, because, i missed part of the pilot last year, and torrented it, and i got the EXACT same letter from them, except it came direct to me, instead of to my ISP.

    you know, just maybe if the damn powers that be would TAKE A FREAKING CLUE they would let us pay 3 bucks to download an episode, or subscribe to a show to get downloads or something other than what they are doing.

    I mean shit, does no one look at recent history?? Napster begins, millions of members get on and start sharing millions of music files. Recording industry gets pissed cracks down on it and finally joins in and authorizes the relaunch of pay-to-download Napster and its Apple iTunes alternative. Between those two PAY TO DOWLOAD services, more digital music exists now than in the old Napster days.

    Come on film industry, catch on. Or do I have to hold your little hand and walk you through it. Welcome to the digital age. :mad:
  • It remains my opinion that, if copyright owners persist in their efforts to limit file-sharing without offering an alternative** ...file-sharing will simply move into "harder" networks (for example Freenet, Entropy, I2P)...

    ...where a node downloads content via multiple other nodes, or onion-routing and onion-encryption ensure that relayers cannot see inside packets, nor tell if the next hop is the destination, or just another relayer, and the datastore of each node contains pieces of countless uploaded materials, so traffic is highly difficult to analyze, and uploaded material replicates itself per demand (being impossible to censor except by lack of demand).

    ----------

    ** I would be willing to donate something to the copyright owner for downloading "Lost" season 1 episode 9 in compatible and quality form (so I can evaluate if the show is interesting).

    But as things are, I entirely lack ways of doing this. Since the show doesn't air where I live, I downloaded one copy free of charge... which turned out to be incompatible with my video codecs (I only use free codecs)... so I need to download another copy.

    Should content providers finally see a flash of light, I likewise hope they won't try using "digital rights management" to limit how I can view downloaded content -- because my Linux system will *not* be supporting technologies of censorship, and should DRM-only material be offered, I might occasionally have to pirate something in future too.

    There exist a variety of programs and netoworks... of various performance and stability (from snail to speedy, bugfest to stable)... which offer notably higher grades of privacy than BitTorrent.

    To obtain a short overview of the history/architecture of file sharing networks, you might consider reading the related article at Wikipedia:
