JMS over IFH

I was e-mailing you to see what you thought about the B5 gaming community

that has emerged over the last few years. Many computer gamers were very

upset over the cancellation of the B5 Flight Sim: Into the Fire. Really, I

was e-mailing you to see if you were aware of an upcoming freeware game

called B5:I've Found Her. I'm not on the team, so I'm not tring to plug it.

You can find their website here http://ifh.firstones.com/index.shtml and

it looks very good. I was just curious as to your opinion on such matters

and whether you are pleased dedicated folks are pulling this off. I know

you like to keep a close affiliation between yourself and the fans.

Unfortunately, the site has prevented on two occasions a genuine license for a cgi computer game based on B5, because the company saw the site and felt there wouldn't be room for a new game for money if one was available free online.

i have send an email to jms about the situation.
perhaps i've got an answer soon

EDIT: here is the email text from the mail i have send to jms

    Hi.
    I' ve seen this posting
    and I have to
admit that now I'm a little bit confused by your answer.
Hadn't been "Into the Fire" canceled before the development of the freeware
game "I've Found Her" began or this propably new approach you were speaking
    about.
Can you give us some more details on your statement why the site/project has
prevented occasions a computer game based on B5.

Besides, I think many B5 fans would buy a comercial Babylon 5 Game if there
    would be one.

The freeware Game is only makeshift by the fans because there is no
commercial Babylon 5 game in sight and therefore IFH should not be seen a
    "threat" to a comercial game.

    Best regards,

  • No...it says that two attempts to get a license for making a B5 based game have been cancelled because executives saw IFH.

And quite frankly...while what JMS speaks is truth...but here's another truth. IFH came about most likely BECAUSE of ITF's cancellation and the refusal of companies to make a Babylon 5 space sim. Not the other way around. So the guys who should have granted the funds for an official product made a big mistake in my book.
  • Drazi GuyDrazi Guy Elite Ranger
Wonder why WB hasn't moved to shut anyone down then... must have decided they do better having this type of thing to keep interest in the DVD's alive rather than license a game.
  • RandyRandy Master Storyteller
I don't doubt JMS, but it reeks of corporate backwards-think and spineless excuses to me. The nearly fanatical push to have at least some kind of B5-based game by the mod faction should instead prove that there is indeed interest in a.) a B5 sim, and b.) space sims in general. Not only that, if the corporate types knew the fans even a little bit, they'd realize that we'd take an official project with a perhaps JMS-written, or at least inspired, story, and assets not available to modders, over something that may be free, and technically outstanding, but still not the "real thing". Am I wrong about this? I think they’ve looked at the data and come out with “proof” for their pre-conceived notions, rather than acknowledging the blue ape in the room. Know what I mean?

    What?!? No way. I'm floored.
  • EdifyYo posted this in the TGU forums:

"This does not sound AT ALL like JMS. First, he's a much better writer, and as one who has followed his postings to Usenet and (before that, CompuServe and GEnie), I can say fairly confidently that he has better grammar than is exemplified in the fake email above. Second, the logic doesn't make sense - if WB didn't think that there would be room for a COMMERCIAL product because of IFH, then they WOULD HAVE SHUT IFH DOWN! It's called COPYRIGHT PROTECTION. Sheesh, the "email" from "JMS" above seems so stupid and like a forgery that I don't know why I even bothered to compose this post.

The_One: if this is truly from JMS, please provide proof - I'll be surprised but (as an IFH fan) pleased to be convinced."
  • BigglesBiggles The Man Without a Face
That does sound very suspicious to me, for the reasons other people have mentioned. If WB knew that they had missed two possible licensing opportunities because of IFH (and if jms knew, then it's reasonable to expect that WB knew), they would have shut IFH down in an instant. It may be free, but it's still copyright infringement. Also, jms has mentioned to me when I asked him about the mods that they were infringement but never said anything about licenses being lost because of them. I can post that email here when I get home if you want.

If it is a true email, then it's probable that the companies involved didn't actually ask WB and considered the situation themselves, but that raises the question of how does jms know without WB knowing?

Oh, and in reponse to that thread's title: IFH could not be responsible for the loss of ITF. IFH was begun well after ITF died, and it only got to the state it's at now recently, which is well after S14S decided to move on.

An interesting thing to remember though: WB wasn't giving out B5 licenses for some time. Maybe they let IFH slide because of that.

My fear is that WB/JMS may wait for it to finish, then sue for ownership and then sell it themselves...

That sounds pretty unlikely to me.

    1. IFH is a derivative work that infringes on Time-Warner's intellectual property. That does not mean that Time-Warner owns the work, or could successfullly sue for ownership. It just means that they have control over whether and how that work may be distributed, and that if profits are made from said distribution, royalties must be paid to the copyright owner for the use of the original work.

    2. I doubt that Time-Warner would really want the kind of negative publicity such a lawsuit deal would generate. It's bad enough when corporations try to control or shut down fan made websites. Although I think most people understand why they do so. But this kind of action would really cross the line with fans.

    3. It wouldn't be cost effective. If they thought the title was good enough to release, it would be cheaper to just cut a deal with the IFH team for royalties than it would be to try to win outright ownership of the title in court. This has actually happened a couple of times in recent history - mod teams have been bought out by game publishers who licensed their product for commericial distribution.

  • bla bla bla bla bla....excuses excuses excuses.......

the sim market its a really difficult one, the problems with FS2 mostly for the ..."fight" of FS2 with star wars games.

the sim market is only a little part of the whole game´s market, and the space sim is aswell only part of the sim market.

sierra had the opportunitie to make the homeworld game for B5 universe or a similar game ....they used other idea, they could make a 3d combat...but they made tribes and half-life, they could make a rpg (sierra was a well- known rpg game company), but again....none b5 related.

    strategy-resource-political game (like civilization etc...not a tactical-strategy game like HW).....but none....

race game....like cars games. ..(formula 1 etc), using space ships or something else,...again none, casino.....none again, elite type....none again, fight combat (like street fighter)...none again....

sierra-havas group has the license to make a LOTR (lord of the rings), game...maybe a rpg game...where is it?.

WB didnt made and do not make the properly use of the idea of b5, they dont understand the meaning of sinergy...and thats why they failed....

more words about this topic its only painfull...cut it down.

How is Salmon? I've almost bought it several times, But i've been hesatant because i've not been impressed with posthumus works, even tho from what i've heard its all stuff that he wrote, just never finished.

The more i think about it, the more i realise how great his loss was,

Except for a finished short story, and the unfinished first 10 chapters of the book he was working on, it is all essays, speeches, and idle thoughts he had stored on his computer. Really funny read, and some of it is really thought provoking stuff. He put alot of thought into alot of things in his short life. Well worth the 40 bucks.

Remains to be seen... damn, now I'm all excited.
