    No matter who wins... the outcome will be irrelevant, because developers of P2P software can go underground.

    I for example cannot determine who "duck" is. I only know that he/she wrote an I2P-adapted version of BitTorrent.

    I know the public key which duck uses to sign stuff... know the destination key to duck's eepsite... but since I was not there in the beginning... and perhaps neither was duck... I cannot know how to sue him/her (and neither should MPAA, RIAA, DVDCSS or anyone else) unless he/she decides to reveal such information.

    Once there is an underground network... there can be underground development... and unless the authorities intercept a project at earliest imaginable stage (assuming such a stage occurs over public Internet)... developers can opt *against* being convenient targets.
