Holy Shit!

Ok so I check my credit report recently & wow umm. Well according to this I owe $237,000! I took out a Mortgage?! BANKS & CREDIT CARDS?! & a loan?

Shit I am really pissed off because I know exactly who took all this crap out under my name. MY MOTHER & I know she can't pay for it she went bankrupt, IN VALENS NAME!

Man I don't know how I'm gonna move out now...

    Sad to say it, but a legal method may be the only way to fix this.

    and I thought I was having a bad time with finances for forgetting to carry a couple checks forward and bouncing a payment... Seems like nothing now...

  • I don't think any agreement can be valid, without the handwritten or digital signature of the person involved.

    Thus, unless you signed an agreement... authorized someone to sign in your name (requires notary certification in most countries)... or gave someone your ID card with the PIN to unlock its highest-grade private key... it should not be valid.

    At least theoretically. Working with multiple assumptions here, so not certain.

    I have no idea! but there is no way I could have done it I WAS 13 at the time of the loan! I didn't have any ID till 03 when I got my passport.

    I won't sue my mom that would probaby just make it worse for everyone.

    Well, that makes it worst for you, and anyway, since you were 13, I suppose that it was not legal for you to have a loan at that age? I dunno what the rules are where you are...

    I dont see how anyone under the age of 18 can get approved for a mortgage.

    when i tried to get one at the age of 22, they went over my life with a fine tooth comb, and there is now way they would miss the fact that the applicant is underage with no income.

    But you did have a Social Security Number, and given the right method of application, that would be all she'd need....

    In addition if you are the only "signer" on any of these debts, not only would they be void since she forged your signature, but also void since you were not of age...

    You may not need to sue your mother directly, but make these creditors aware (if they are not already) that your mother used a minors name and SSN to defraudulent their organization. Dependant upon the situation this may also negate any bankrupcty settlements she received since there was fradulent intent.

    I can't sue her she has no money. Shes living with my grandmother thats how desperate her situation is right now. I don't really want to get into it but I don't have any way of paying for a lawyer & she sure as hell doesn't.

    You need to contact your creditors and get this fix. This type of thing will practically destroy any hope you have to get a decent credit rating for the rest of yoru life.

    Well I tried calling the bank in question & no one is picking up. I've tried three times now & can't get in touch with anyone. The 800 number I was givin is also crap I call up & get the same spanish lady all the time. "no cant we cant authorize this sir. You have to use the [I]other[/I] toll free number & that one is even worse. Finally I call the bank directly & no one picks up. Im suspecting it may not even be her now who knows.

    Whatever you may or may not want to do, you need to get this fixed or you'll be unable to do important things like get a mortgage or a loan to start a company later in life.

    In the USA , the FBI can do a lot. This is Fraud/Identity Theft.

    The natural parents of our Foster Children pulled that stunt. Even tried to claim them on their tax returns to get the credits, when they hadn't had the children for several years.

I don't know how things are there but fact that papers are "signed" with name of 13 year old should make warning lights flash on bank's side so this might become quite "termite hill" to investigate.

    Ok so I got in touch with my mom. She knows nothing. I still haven't got a response from the bank in question either.

    The Credit Agency is already doing their own investigation which will take 30-45 days & I have to pay the $10 fee.

    Right now Im not panicing cause no one is at my door & that stuff from 1999 is the only thing on there. So whoever it was went on a little spending spree & then never used my name again. It may not be my mom it could have been anyone I don't know how? But I know they are laughing in the darkest dungeons of the internet.

    I honestly think this stuff will be cleared. Since there absolutely no way in hell I could have taken a mortgage out.

    Well I have sold some electronic parts to them here in NYC, the agents always use their goverment issued purchasing credit cards. It is rare through, definitly not on daily or even quarterly bases.

    I remeber in the late 70's or early 80's going on tour of the FBI building in D.C. when I was a youngin.. They had a huge picture of J Edger Hoover staring at you.. Scary stuff

    FBI employees aren't as scary as you'd think. One of the engineers at work had an interview with one of them when his friend was hired for a government position, and from what he told me the FBI guy was completely polite and friendly.
