legal help and PC thieves

some of you guys no doubt remember me posting a 'build my pc for me' type post where you guys all contributed to the design and spec of my new machine. This was back in Sept 2003.

I ordered it, and shipped it to a US pal of mine. Unfortunately, believe it or not, she commited suicide... that sucks in itself, but... along comes her nefarious brother... sees one half of my shipment of computer parts in Mary's estate stuff and says, "Woah... I'll be having those. "

I've provided reciepts of payment to her, every possible little detail and no dice. The guy is hoping he's going to be able to weedle out of it one way or another. The cockroach... the worst thing is I know this guy is a asshole, my friend told me lots about him before she popped her clogs, and I know he wont play by the rules until he's threatened with violence/lawyers....

... I need a can of whoopass bugspray in the form of a lawyer, or atleast the threat of a law suit.

The guy has over 1300 USD worth of my SHIT and he's NOT keeping it.

Also, Jack... sorry but your case is amongst the stuff he's effectively in the process of stealing. I will make ammends somehow.

So...

I remember someone here had a legal contact, that they'd written a threatening letter to someone, I think in regards to some copyright issues.

Could you do me the kindness of something similar ? I can write the letter, but I need some verifiable 'letterhead' so to speak.

Help me deal out some karma...

...this guy is one of the least deserving people on the planet and I will not be party to allowing him to profit for anyones misfortune, mine or not.

  • I know a lawer but he specialises in other things. Although I don't know what your legal recourses are if you shipped it to that house, it could be a tricky issue. Although you can prove that its your property. You can probably take him to small claims court, but of course you would either have to hire a layer to represent you in court, or come here yourself and do it.

    I forget if your in the US, if your not this may not apply.

    I'm not sure this is something you'd need a lawyer for. How far away is this person? The least costly way to recover at least the cost of the items would be small claims court in the county that person is located in. Most small claims limits are 2000 - 3000 dollars.

    Send the brother a certified letter stating you expect either one of two things, to recover to items you had sent to his sister, or to be reimbursed for the retail replacement cost of each item. Make sure you provide a detailed list of the items, along with reciepts (if available) or an example of the replacement cost (ad copy) if you have no reciept, in the same letter. Provide a reasonable deadline by which he is to take this action, stating if he does not, you will file a complaint in small claims court.

    If you do end up filing in small claims, make sure you also including any verifiable costs of recovery. including your cost of travel to any court proceedings, if its a long ways (airline ticket, etc). You may not always recover that money, which is a risk you'll take, but you can't recover it if you don't ask.

    What state is the guy in and what is his name, Its time to let loose the virtual dogs of war.

    small claims court is the way to go, but you probably will need somebody to represent you in court, but not necessarily a lawyer. Since small claims court is deisgned to keep lawyers out of the mess.

    I'm giving him this week.

    Then I get very 'firm'.

    I'll send the details thru to you this weekend and you can send him the appropriate letters of 'you're legally dead mofo'. I don't think he expects me to have US backing... *muttley snigger*... asshole is going to get it in the neck !

    MMM do we have somebody in Michigan who can actually go over there in person and cause trouble? if not Im going to have to go through michigan state law on this and see how to pursue it from outside the jurisdiction of that state.

    Well, that's not my fault. The article was on the main page for the entire day and all you had to do was type in [url]www.slashdot.org[/url].

    How hard is it to use google to find stuff?
