boy o boy does this have ramifications for the web, and to an extent for the "right to free speech"... no longer does the American legal system run rough shod over everyones idea of the law, or atleast its going to take balls of stainless steel to put controversial of risky stuff on the web...

reading between the lines, I think this is the beginning or a genuine 'world court' a unified legal system, built almost by default because of the webs universal and ingrained part of modern culture...

    Problem is the decision is worthless as the second article points out due to the fact that the US isnt going to enforce an Australian court descision.

    I DONT like the trend to a world court, because as Ive said in previous threads its going to lead to alot of shooting, because in the end alot of people are going turn the accusation you just made against you.

    In the end I think the US supream court is going to make a very interesting old fashion descision, in that for damages to be applicable or criminal charges to be applicable you either have to have been there physically, or that the alleged charge must meet US criterion or there will be no action taken.

    The canada Uganda piece was interesting, so Canada's idea of law trumps over Uganda? how imperalistic! Australia over the US/ or vice versa?

    Frankly I think it comes down to this, we in the US can put what ever we want on US web servers as long as its legal here. You wanna stop us from doing that? make us, and were gonna sortie the boomers, because were gonna be spoiled little brats about it and end the whole game if we have to.

    I mean isnt that the whole thrust of the anti imperliastic arguments?

    I just dont see a real world court forming because there are to many cultures out there who DONT agree on standards, between conservative Islamic nations, China and other places, its a strong argument to maintain de linked legal system for another century or two.

    I agree with Tyvar, how can another country say what is legal or not legal in another.

    you miss the point fellas.... out of sheer fiscal neccessity the media moguls will have to make sure thier content is clean as a whistle. To try and block access to the net from a country with tight defamation laws is commercial suicide, dropping content for certain countries will just lead to 'creative routing' and people forwarding 'offensive material' around such blocks, thereby 'defaming' someone in the 'target country'.

    You either clean up you act or get sued into a commecial nihil. Simple as that. Money does not give two flying fuggs at a rolling donut about borders and 'whose legal kung fu is better than whose'. If I sue you for a million bucks, and win, and you have a commecial stake in that country, or in fact any real dealings or even your country has good relations with... its still going to hurt, no matter the current exchange rates with AU to USD.

    Even if I can't sue the American based Dickhead e-Zine for calling me a wanker, I can sure as hell sue the parent company Stupid Media Moguls who has physcial and 'real' offices and paid taxes here in AU.
