This is what I warned you about two years ago. Get one party, especially a party made up of those who consider themselves above everyone else, and you get this kind of thing. Congratulations.

This was a piece of the Homeland Security bill that just passed the Senate; before it can go into effect, it needs to go back to the House, so they can vote on whether to accept the changes made to the bill by the Senate. After that, it goes to President Bush, who can either pass it or veto it; my guess is that it'll pass both of those stages. Once that's done, it'll formally be a part of law.

By the way, this part of the bill -- the access to credit card statements, e-mail, web logs, etc. -- was not in the original Homeland Security bill. It was added during the last days before the House passed it, hidden among some four hundred other pages of additions. The original bill was less than forty pages, which should tell you something about how crummy laws get passed: they get tacked on to otherwise perfectly legitimate bills, which must then either be passed with the terrible changes in place, or refused entirely. I'm of the opinion that the Homeland Security bill should have been refused entirely due to this and many, many other frivolous additions.

One other aspect should be noted: this type of monitoring is already mostly in place for many European countries. Doesn't mean I want it here, though. The idea is that the government has complete legal access to pretty much all records kept by corporations, without warrant. It therefore has access to your credit card company's record of your expenditures. To your ISP's record of your user name and IP address. To all sorts of other personally identifiable information that, really, they have no business knowing without warrant. I find this insulting.

My guess is that the law will be immediately challenged once activated; it'll probably spend a year or two on its way to the supreme court, where it will likely be struck down as a violation of the fourth amendment. That is my hope, anyway.

A####, you're a bit slow. This has been going around for a long time now. I seriously doubt it'll get passed because of the public uproar it would create. I see this going the way of TIPS....down the drainpipe.

That being said, I suggest everyone that is a US resident call their congressman and give them an earfull about this anyways. Just to be on the safe side.

We did call our congressmen and senators. Tied up the fax machines for days with staements against this bill. Did no good. The Dems have grown spineless and the Repugs are so eager to fellate Bush that they'll do anything for him.

• I'm not a U.S citizen, but I did grow up in the U.S. I consider this my home, and while I am not yet legaly recognized as one, I am as american as anyone else in this country. It pains me not to be able to speak out on such issues that are troubling, if not alarming. I was taught in school that the constitution was the highest law in the land, that the rights of the individual would never be circumvented. Perhaps this will still be true as I attain my citizenship in the next few years, but if not I won't just leave. I will not run away and let this country fall into darkness, because if the greatest symbol of freedom on this planet is overshadowed by some well intentioned yet sinister police state the future of human liberty as a whole will be in danger.

For now though, all any of us can do is keep our eyes open and watch to see if we are just overeacting or if the shadows are truly falling on America.

The US public who stayed home and didn't vote, the public who think that Bush is some kind of everyman saint, the public who ignored radical right wing and elite, mega-wealth corporate influences, the public who shoved their heads in the sand while castigating those who were sounding the alarm by calling us paranoid conspiracy nuts - all deserve what they get. Unfortunately, I get to live under Bush's imperialistic administration too. • I don't think Bush will sign off on this (Provided he wasn't the one that came up with it...if he was...Biggles, I'l join ya).

like I said, if this goes though, I might just move to Australia.

ohh..theres an idea for a pettition.
Bush: "Yes?"
Cab member: "Umm, sir, we just got a pettition about that new bill..."
B: "Yea, whats it say?"
C: well...it solved the over crouding issue.
B: hows that?
C: roughly 3/4 of the US citizens moved out. Went to Canada and Australia.

He's the one who submitted the original proposal. (Actually, even that's not quite true; Bush's original proposal was based on something Joseph Lieberman came up with.) The original proposal, however, was 37 pages, and had absolutely nothing in it about government access to corporate records, private e-mail messages, credit card bills, and the like. You can thank Poindexter, of Iran Contra fame, for that one.

The bill that Bush submitted and the bill that was eventually passed are two almost entirely different animals. Despite that, I still think that Bush will sign it, particularly given the large margins by which it passed: 299-121 in the House, and 90-9 in the Senate.

Once signed into law, it will take a long time to implement, since a great deal of it calls for finding new ways to do things to accomodate the government's snooping. During that time, I find it highly likely that it will be challenged in the courts, probably fast-tracking to the Supreme Court, where I can't imagine it not being struck down as a violation of the fourth amendment.

Depsite the terrible bias of the Supreme Court, they have been fairly good about supporting fourth amendment rights for the most part. With the way Dubya is backing this particular monstrosity, though, I predict any challenges will be struck down 5-4.

Right... the thing to keep in mind here is that these changes are mostly just switching over to a system that's already in use elsewhere.

You guys on the Left crack me up. You keep voting for big government and get mad when it bites you in the @$$. Now, had we kept government true to its original purpose, perhaps this nonsense could have been avoided. But tell me this, if Bush is indeed trying to "solidify" his hold on power by passing legislation that no one will adhere to, how is he going to win re-election?

If you don't like what is going on, propose an alternate plan to rectify a solution rather then sit there and bitch.

You think that this Homland Security is an infringement of your rights, that's okay, fine. Do you have a better idea to accomplish the same goal of weeding out terrorists without violating the rights of others?

And once again, anyone who states that Bush started this whole "American imperialism" neglects the past hundred-four years. We've been on this path since Teddy Roosevelt persuaded President McKinley to involve the country with what became the Spanish-American War. While our "empire" was necessary to ensure the security of free nations during the Cold War, it is the fault of Bush Sr. and Clinton for not bringing our troops home during the post-Cold War era.

Neo-conservatives aren't radical right-wing nuts. They are a blend of conservatism on certain things (pro-life, strong military, fossil fuels, etc) yet are liberal on others (pro-free trade, interventionist foreign policies, and until recently, adding more government).

Paleo-conservatives differ in that our foreign policy is America First (we won't attack unless fired upon first or security is threatened), Protectionist (not necessarily anti-free trade, but more or less fair trade so not every factory worker's job ends up in Mexico or China), self sufficient nation (again the Protectionist deal), and less government on the federal level.

I'll have to take a look at exactly what the bill does to see if a better plan could be installed.

ALL RIGHT PEOPLE!!! We can stop the SKY IS FALLING act and the Bush bashing, there is no such provision in the Homeland Security bill!

See here:
http://www.freedom.gov/library/technology/darpa.asp

and here is the bill itself (all 484 pages). Look at section 892. It specificly prohibits use of this bill to violate an individuals constitutional rights:
http://hsc.house.gov/legislation/hr5710.pdf

Folks,

Please make sure you know all the facts before passing judgment. The Homeland Security Act is mainly a reorganization of existing departments and will have a minimal effect on most of us.

YES!!! What he said! You people who are complaining now, where were you when the precedence was being set? All these privacy's you think you're loosing, in fact you had already lost long ago. I find the Europeans, Canadians, DownUnder'ers on the board trying to warn us about our freedoms being lost silly, look at your own nations. I remember living on the economy in Germany vividly and the vast differences.

In general yes. But quite a few ammendments got tacked on to it that do impact us.

Anyone know where to get a list of what the ammendments do?
